Scope and operator

These Terms apply to purchases of Trail Tattoo products by consumers and business customers where relevant. They form part of the contract between the customer and Trail Tattoo.

Mandatory consumer rights and protections granted by applicable law remain unaffected and prevail over any conflicting provision in these Terms.

02

Products

Trail Tattoo produces customised temporary tattoos from designs created and submitted by customers through the Trail Tattoo editor. Every tattoo sold through the standard online editor is individually produced according to the customer’s specifications.

Depending on the options offered in the editor, a design may include a course or elevation profile, text, distances, colours, markers, checkpoints, aid stations, notes, logos and other supported design elements.

03

Customer responsibility for the design

The customer is responsible for reviewing the final design before placing an order. Where applicable, the customer must verify:

  • the course or profile, distances and elevation information;
  • text and spelling;
  • colours and logos;
  • marker positions, aid stations and checkpoints;
  • quantities and dimensions;
  • any other customer-controlled design element.
04

Order process and contract formation

The standard order process is:

  1. The customer creates a customised tattoo.
  2. The customer adds the design to the cart.
  3. The customer reviews the order.
  4. The customer enters the required contact and delivery information.
  5. Shipping costs and the final price are displayed.
  6. The customer explicitly accepts these Terms & Conditions.
  7. The customer proceeds to Payrexx.
  8. Payment is processed through Payrexx.
  9. The order is confirmed when Payrexx confirms successful payment.

Contract formation

The contract is concluded when successful payment is confirmed by Payrexx. At that point, the order is confirmed, the design can no longer be modified, the customer cannot cancel merely because they changed their mind, and the customised product may enter production.

05

Review and correction before payment

Before payment, the customer has an opportunity to review and correct the design, quantities, contact information, delivery address, country, available shipping option, shipping costs and total order amount.

06

Prices and currencies

Trail Tattoo may display and accept prices in CHF, EUR or USD depending on the customer and site configuration. The final currency and total amount payable are displayed before payment.

Any taxes charged or collected by Trail Tattoo, where legally applicable, are reflected in the order or checkout. Currency availability and any conversion applicable to a particular order are shown before payment.

07

Payment

Payments are processed through Payrexx. Available methods may include payment cards, TWINT and other methods supported by Payrexx, depending on country, currency, device and availability.

Trail Tattoo does not directly process or store the customer’s complete payment-card credentials. Payment information is processed through Payrexx and the payment provider involved in the selected method.

Payment must be successfully confirmed before the order is confirmed and enters production.

08

Production time

The normal estimated production period is 10 to 20 days. This is an estimate, not an absolute guaranteed delivery date.

Production time covers preparation and manufacture of the customised tattoo. Shipping or transit time begins separately after production and must be added to the production estimate.

09

Shipping

Trail Tattoo sells and ships internationally to the destinations enabled in checkout. Availability is not guaranteed for every country.

Shipping costs are displayed before payment. Delivery estimates vary according to the destination country, the postal or logistics service, customs processing and operational circumstances. Unless expressly stated otherwise for a particular order, delivery times are estimates rather than guaranteed dates.

10

Customs, import taxes and duties

Unless Trail Tattoo is required by applicable law to collect such amounts at checkout, any import duties, import VAT, taxes, customs-clearance charges or other import-related charges imposed by the destination country are the responsibility of the customer.

Customs processing may affect delivery times.

11

Personalised products, cancellations and returns

Trail Tattoo products are made according to each customer’s individual specifications. Once payment has been successfully confirmed, the design cannot be changed, and the order cannot be cancelled merely because the customer changes their mind.

Trail Tattoo does not offer voluntary returns for correctly produced customised products. Where applicable consumer law provides an exception to a normal withdrawal or return right for personalised products, that exception may apply.

This does not limit mandatory rights relating to defective, damaged, incorrectly produced or otherwise non-conforming goods.

12

Defective, damaged or incorrect products

If a tattoo is defective, damaged, materially different from the confirmed design because of a Trail Tattoo production error, or otherwise incorrectly produced by Trail Tattoo, the customer should contact Trail Tattoo promptly.

  • Include the order reference;
  • describe the problem;
  • provide clear photographs showing the issue where reasonably possible.

Available resolution

Where reasonably possible and legally permitted, the customer may choose between a free replacement and a refund for the affected product. Photographs form part of Trail Tattoo’s normal assessment process, but statutory rights do not automatically disappear solely because a photograph cannot be provided.

13

Customer design errors

If the physical tattoo accurately reproduces the final design approved and ordered by the customer, Trail Tattoo is not responsible for mistakes originating from that design or the customer’s information. Examples include a typo, incorrect distance or checkpoint, incorrect event information, the wrong logo, unsuitable uploaded content or a colour selected by the customer.

This does not apply where the physical tattoo materially differs from the design actually ordered because of a Trail Tattoo error.

14

Lost shipments

If a shipment is reasonably determined to have been lost in transit, the customer may choose, where reasonably possible, between a replacement and a refund. Trail Tattoo may first carry out a reasonable investigation with the postal or logistics provider.

15

Incorrect delivery address

The customer is responsible for providing a complete and accurate delivery address. If an order cannot be delivered, is returned or requires a new shipment because the customer supplied an incorrect or incomplete address, Trail Tattoo may require payment of the additional shipping costs before resending it.

This does not apply where the delivery problem was caused by Trail Tattoo.

16

User-supplied content

Customers may add supported content such as logos, sponsor logos, text, graphics or images to a tattoo. The customer represents that they have the rights, permissions and licences necessary to use and reproduce all submitted content.

The customer grants Trail Tattoo a limited licence to receive, store where necessary, process, reproduce, print and manufacture that content only as necessary to provide the service and fulfil the order. Trail Tattoo does not acquire ownership of customer content.

To the extent permitted by applicable law, Trail Tattoo is not responsible for intellectual-property infringement caused by content supplied by the customer.

17

Right to refuse content or orders

Trail Tattoo may refuse or cancel an order where reasonably necessary, including where submitted content is unlawful, clearly infringes third-party intellectual-property rights, cannot lawfully be produced, creates a material technical production problem or violates applicable legal requirements.

Trail Tattoo may also refuse an order it cannot reasonably fulfil. If an already-paid order is refused before production and the product is not supplied, the corresponding payment will be refunded unless withholding an amount is legally justified.

18

Course information and navigation disclaimer

A Trail Tattoo may display an elevation profile, distance, elevation gain or loss, checkpoints, aid stations, time goals, customer-entered notes and other race or course information. It is intended only as a convenient visual reference.

It is not an official course map, navigation system or safety device, and does not replace official race instructions, trail markings or appropriate GPS or navigation equipment where required.

Customers and runners remain responsible for following official course markings, organiser and safety instructions, applicable rules, and actual terrain and weather conditions. Trail Tattoo does not guarantee that customer-provided course or GPX information remains accurate if an organiser changes the route after the tattoo is ordered.

Nothing in this section excludes responsibility for an error introduced by Trail Tattoo.

19

Temporary tattoo material and safety

Customers must follow the application, use and removal instructions supplied with the product.

Any safety or testing statement about the material is limited to the exact wording supported by verified product documentation and is not an independent Trail Tattoo guarantee.

20

Application and skin precautions

Customers must follow the application, use and removal instructions supplied with the product. Those instructions form the authoritative product guidance and must be reviewed whenever the material or supplier documentation changes.

21

Product durability

Temporary tattoo durability varies according to application, skin, friction, sweat, position on the body, water exposure and care. Any duration shown elsewhere on the website is a typical estimate rather than a guarantee.

22

Screen preview and physical product

Screens, printing systems and physical tattoo materials can reproduce colours differently. Small differences may occur between the screen rendering, digital preview and physical printed tattoo.

Minor variations inherent to normal screen and printing processes do not necessarily constitute a defect. This does not permit a materially different design or materially incorrect colour.

23

Promotional codes

Trail Tattoo may offer promotional or discount codes. Conditions specific to a code are displayed with the relevant promotion or applied according to its checkout configuration.

The final discount and amount payable are visible before payment. Promotional codes are not redeemable for cash unless Trail Tattoo expressly states otherwise.

24

Large orders

Trail Tattoo may review unusually large, unusual or technically complex orders before production. It may contact the customer, request additional confirmation, agree specific production conditions or refuse an order it cannot reasonably fulfil.

If an already-paid order is refused because Trail Tattoo cannot fulfil it, the corresponding payment will be refunded.

25

Business customers and event organisers

These Terms also apply to business customers and event organisers unless separate written conditions have been agreed.

For business or large-volume orders, the parties may separately agree quantities, pricing, production schedules, shipping, artwork, proofing, payment or other project-specific conditions. Where a specific written agreement conflicts with these standard Terms, that agreement governs the relevant order.

Consumer-specific statutory protections apply only where the customer is legally entitled to them.

26

Intellectual property

Customer-uploaded content remains subject to the customer’s or relevant third party’s rights. Trail Tattoo does not claim ownership merely because a customer uploads a logo, event or sponsor logo, artwork, or GPX or course data.

Trail Tattoo retains its rights in its website, branding, editor, interface, software, original graphics, templates and proprietary materials, subject to applicable law and third-party licences.

27

Limitation of liability

To the extent permitted by applicable law, Trail Tattoo is not responsible for indirect or consequential loss resulting from incorrect information supplied by the customer, customer design errors, improper application or use, reliance on a tattoo as a navigation or safety device, or circumstances outside Trail Tattoo’s reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded, mandatory consumer protections, responsibility for intentional wrongdoing or any other liability that applicable law prohibits from being excluded.

28

Events outside reasonable control

Trail Tattoo is not responsible for delay or failure caused by exceptional events outside its reasonable control, such as major postal or logistics disruption, natural disasters, major infrastructure outages or governmental restrictions.

Where reasonably possible, Trail Tattoo will inform affected customers of significant delays, try to fulfil the order as soon as reasonably possible and provide an appropriate resolution if performance ultimately becomes impossible. This section does not excuse ordinary production mistakes or negligence.

29

Privacy

Personal information relating to orders, payment and delivery is processed as described in the Trail Tattoo Privacy Policy.

Privacy Policy
30

Governing law

The contractual relationship is generally governed by Swiss law. This choice does not deprive consumers of mandatory protections granted by laws applicable to them that cannot legally be excluded by contract.

31

Jurisdiction

Competent courts are determined according to applicable jurisdiction rules. A Swiss venue may be agreed with business customers where legally valid. Consumers retain any mandatory jurisdiction rights provided by applicable law.

32

Changes to these Terms

Trail Tattoo may update these Terms for future orders. The version applicable to an order is the version presented or made available when the order is placed.

Changes do not retrospectively alter an already-concluded order unless required by law or agreed with the customer.

33

Severability

If one provision of these Terms is invalid or unenforceable, this does not automatically invalidate the remaining provisions, subject to applicable law.
